November 2022, the State Administration of Market Supervision revised and issued the new Rules. This new policy of safety supervision of infant formula milk powder, known as "the strictest supervision level in history", further strict production license conditions and raw material control, and put forward stricter and more detailed requirements on milk powder production sites, equipment and facilities, process flow, personnel management, system management and so on.

The new Detailed Rules require enterprises to further improve dynamic management mechanisms such as daily control, weekly investigation and monthly scheduling based on food safety risk prevention and control, and require corresponding disposal measures to prevent and control risks. First Formula Registration Management System

The "Measures" require that the formula should comply with the requirements of relevant laws and regulations and national food safety standards, and provide research and development and demonstration reports and sufficient basis to prove the scientificity and safety of the product formula.
Based on the principle of further improving the standardization and transparency of the work of the review agency, the new "Measures" clarified 8 types of non-registration situations, such as fraudulent and untrue application materials; scientific and insufficient safety basis for the product formula; The applicant does not have the research and development capabilities, production capabilities or inspection capabilities suitable for the product formula applied for registration; the applicant fails to confirm the date of on-site verification within the time limit, refuses or does not cooperate with on-site verification and sampling inspection; the conclusion of the on-site verification report or the conclusion of the inspection report is not in conformity with the registration requirements, etc.
The new "measures" also explicitly prohibit repackaging in disguised form and stipulate that applicants who use compound ingredients that have met the nutritional requirements of the national standard for infant formula food safety as raw materials to apply for formula registration shall not be registered.
